Terms of service

1. About Blood & Sand
Blood & Sand is an experimental entertainment service featuring simulated arena contests between fictional human and animal characters. Spectators can watch in a browser and use the participation features available at the time.
The operator is GigaDuck OÜ (registry code 17501858, Estonian Commercial Register; VAT number EE102984419), Tornimäe tn 5, 10145 Tallinn, Estonia. Contact: info@gigaduck.ai.
These terms describe the conditions for accessing the service and using its participation features. Please read them before participating. Where a feature asks you to accept these terms, that acceptance is separate from any consent required for personal-data processing.
2. Age and content
You must be at least 18 years old and meet any higher applicable local minimum age. The service is not offered to children. Parental permission does not override this requirement. Do not allow children to use your account or deliberately circumvent an age restriction.
Content warning: fictional human and animal violence, blood, injuries, death, and execution or mercy decisions. The presentation may change and may be graphic or disturbing. It does not encourage real-world violence or cruelty, or provide fighting, medical or safety advice. Stop viewing if the content causes discomfort.
3. Accounts and public participation
Watching does not require an account. Certain participation features require a supported sign-in provider and an eligible account. Keep your account credentials secure and notify us of suspected unauthorised access. You are responsible for your device, connection and ordinary connectivity charges.
Enrolling as a citizen creates a public game identity. Your chosen citizen name, seal, rank, gold statistics and certain wagers, gifts and winnings may appear in the arena and public rankings. The Privacy Policy explains this processing, including public game records and AI name checks.
Do not impersonate others, misuse multiple accounts, automate participation, exploit faults, bypass restrictions, access private systems, overwhelm the service or infringe another person's rights. Do not use the service to threaten people or promote real-world harm. These restrictions do not prevent activities expressly permitted by applicable law. Report suspected vulnerabilities privately to info@gigaduck.ai.
4. Matches, votes and gold
Matches use automated controllers, including AI, and may produce unexpected or unequal outcomes. Votes and crowd actions influence the game only as its rules permit. They do not guarantee any character's survival, victory or behaviour. A submission takes effect only when accepted by the server. Each voting round allows one accepted vote per account, which cannot be changed in that round; cheers and boos may be updated when the service permits. Reactions contribute to the live crowd presentation rather than deciding match outcomes.
Gold is fictional play money granted by the game. It cannot be purchased, redeemed for money or prizes of monetary value, or traded outside the game. Selling accounts or gold, or arranging payments for transfers through game activity, is prohibited. Gold is transferred between citizens only through the game's pools. Welcome gold is granted once per Google or Apple account, and daily gold at most once per day. Deleting and re-creating an account does not reset those limits or gift cooldowns.
Citizens may stake gold in shared pools and spend it on gifts for fictional fighters. Losing stakes can pass to winning citizens. The game may also contribute an advertised purse of additional fictional gold. Gifts can affect a fighter's equipment or condition but do not guarantee a result.
A citizen may back one side per bout and increase that stake while the Book remains open. Accepted stakes cannot ordinarily be withdrawn or switched. Displayed returns can change before the Book closes and are not probabilities or guarantees of winning. The server's acceptance time determines whether a submission arrived before the deadline.
Winning backers share the losing stakes and any applicable advertised purse in proportion to their stakes. Whole-gold rounding remainders go to the largest winning stake, with ties resolved by the earliest wager and then its identifier. Stakes are returned when a bout is void, no eligible side wins or nobody backed the winning side. Where only the winning side has backers, their stakes return and any applicable advertised purse is distributed. Gifts are returned when a card is cancelled before admission; gifts already used in an admitted bout remain spent.
All returns and refunds are in fictional gold. The current service charges no participation fee and offers no cash prizes or real-money wagering. Future paid features would require separate purchase terms.
Participation does not confer ownership of a character, an investment or a financial interest. Characters, gold balances, names, rankings and other fictional progress may be changed, reset or removed as described below, subject to mandatory rights.
5. Changes and availability
The service is under development. We may change features, rules, characters and supported devices, correct errors, reset fictional progress or discontinue the service for development, operational, security, legal or commercial reasons. Maintenance, capacity limits, supplier outages and technical problems can interrupt access or participation.
We do not promise uninterrupted availability, a minimum operating period, particular updates, individual support or recovery of fictional progress. Any legally required notice, justification or remedy remains available. Urgent security or legal action may take effect immediately where permitted.
6. Content and gameplay sharing
Rights in the service's software, artwork, branding and other content remain with us or their respective owners, to the extent those rights exist. Third-party and open-source licences continue to apply.
You may access the service for personal entertainment and create, share and monetize your own gameplay screenshots, videos and livestreams. Credit Blood & Sand and link to bloodsand.com where practical. You do not need separate permission solely because your gameplay content earns advertising, subscription or sponsorship revenue.
This permission does not allow standalone asset resale, redistribution of our software except under an applicable licence, false claims of endorsement or infringement of third-party rights. Other commercial exploitation requires permission unless applicable law or a separate licence permits it. Your independently created commentary and other original contributions remain yours.
7. Restrictions and account closure
We may restrict or suspend access where reasonably necessary to address abuse, security threats, ineligibility, material or repeated breaches, legal requirements or service closure. Immediate action may be necessary; legally required explanations and review rights remain available. Automated request and connection limits can temporarily restrict access.
Contact info@gigaduck.ai to question a restriction. Provide enough information to identify the issue without sending passwords or sign-in tokens. This does not guarantee reinstatement or create a voluntary support response deadline.
You can stop using the service at any time. Use “Delete account” where offered, or request account closure or personal-data deletion at privacy@gigaduck.ai. Signing out does not delete your account. The Privacy Policy explains deletion and any lawful retention exceptions.
8. Warranties and liability
Subject to mandatory legal rights, the service is provided “as is” and “as available”, without additional voluntary warranties concerning availability, compatibility, AI behaviour or preservation of game records. Feature descriptions do not create an uptime or service-level guarantee.
To the extent permitted by law, we exclude liability for business losses, including lost profit, revenue or business opportunities, and losses that were not reasonably foreseeable when the contract was made. Fictional losses do not themselves create an entitlement to monetary compensation; applicable legal remedies remain available.
Nothing excludes or limits liability for fraud, intentional misconduct, gross negligence, death or personal injury where exclusion is prohibited, or other liability that cannot lawfully be excluded. Mandatory consumer and data-protection rights, security obligations and remedies remain unaffected.
9. Privacy
Our Privacy Policy explains what information we process, its purposes, recipients, retention and your rights. Agreement to these terms is not blanket consent to personal-data processing.
10. Disputes and revisions
Estonian law applies, without removing mandatory protections available to consumers under otherwise applicable law, including the law of their habitual residence where applicable. Estonian courts have jurisdiction subject to mandatory consumer jurisdiction rules, including any right to bring proceedings in your home jurisdiction.
Contact info@gigaduck.ai about complaints. This does not prevent recourse to a competent court or regulator. Eligible consumers may also use the Estonian Consumer Disputes Committee.
Revisions will identify their effective date. Where legally required, we will provide advance notice through the website or a durable medium such as email and obtain renewed agreement. Revisions apply prospectively and do not remove accrued claims or mandatory rights. If you do not accept a revision requiring your agreement, you may stop using the service and request account closure.
If a provision is unenforceable, the remaining provisions continue to apply where legally possible, and applicable law governs the affected matter. A delay in enforcement does not itself waive a right.
